Overview

EverShot ("the App") is a dual-camera video recording app. This policy explains what the App accesses, how that information is used, and what we do — and don't do — with it.

Your recordings stay on your device. We never see, upload, or store your videos. The only information that leaves your device is the limited data needed to process subscriptions and purchases, described below.

Information We Do Not Collect

We do not collect, sell, or share:

Camera and Microphone Access

EverShot requires access to your device's cameras and microphone solely to record video. This content is processed entirely on your device and is never uploaded, streamed, or transmitted anywhere.

You can revoke camera and microphone access at any time in Settings → Privacy & Security on your iPhone.

Photo Library Access

After recording, EverShot saves your video clips directly to your Photos library. The App requests write access to your photo library for this purpose only. We do not read, scan, or access any existing photos or videos in your library.

You can manage this permission at any time in Settings → Privacy & Security → Photos on your iPhone.

Data Storage

All video files are stored locally on your device. When a recording is saved successfully to your Photos library, its temporary working file is deleted automatically.

If a save does not complete — for example, because Photos access is turned off or your device storage is full — the recording is kept in the App's private on-device storage so that you can recover it. It stays there until you save it or delete it yourself. None of this ever leaves your device, and your recordings are never stored on our servers.

Subscriptions and Purchase Data

EverShot offers auto-renewing subscriptions. Purchases are processed by Apple through the App Store — we never receive or store your payment card details.

To unlock features and manage your subscription, we use RevenueCat, Inc., a third-party service that records purchase events. For this purpose, RevenueCat and Apple may process a randomly generated app-user identifier, your subscription and purchase history, and basic device and country information.

This data is used only to deliver and validate your subscription, prevent fraud, and understand aggregate purchase trends. It is never used to advertise to you and is not sold to anyone. You can review Apple's and RevenueCat's own privacy practices in their respective privacy policies.

Third-Party Services

The App uses two third-party services, both solely to operate subscriptions:

The App contains no advertising networks and no other third-party analytics or tracking SDKs beyond what is described above.

Diagnostic Information

If you choose to report an issue from within the App, EverShot prepares an email to us that includes basic technical details about your device and settings — such as your device model, iOS version, App version, and the recording mode and quality settings in use. This information helps us diagnose the problem faster.

Nothing is sent automatically. The email is created in your own mail app, and you decide whether to send it. We use this information solely to respond to your report.

Your Choices and Rights

Depending on where you live, you may have rights to access or delete the limited data associated with your purchases. Because that data is tied to an anonymous identifier held by Apple and RevenueCat, please contact us at hello@bentested.com and we will help you exercise those rights.

Children's Privacy

EverShot is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided information through the App, please contact us and we will take appropriate steps to address it.

Changes to This Policy

If we update this privacy policy, the new version will be reflected in the App with a revised "last updated" date. We encourage you to review this page periodically.

Acceptance of Terms

By downloading or using EverShot ("the App"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use the App.

Use of the App

EverShot is licensed to you for your personal use to create your own video content. You own the videos you record and may use them however you wish, including commercially.

You agree to use the App only for lawful purposes and in a manner consistent with all applicable local, national, and international laws and regulations.

Subscriptions, One-Time Purchase, and Billing

EverShot offers auto-renewing subscriptions that unlock the App's features:

EverShot also offers a one-time "Lifetime" purchase (for example, $14.99, in your local currency) that unlocks the App's features permanently on your Apple account, with no recurring charges. A one-time purchase is not a subscription: it does not renew and is not billed again. Payment is charged to your Apple ID upon confirmation of purchase.

All purchases are non-refundable except where required by law or under Apple's App Store refund policies. Prices are shown in your local currency, may vary by region, and may change over time in accordance with App Store rules.

Recording Consent and Privacy Laws

Recording individuals without their knowledge or consent may be illegal in your jurisdiction. It is your responsibility to understand and comply with all applicable recording consent laws before using EverShot to capture video or audio of others.

We are not liable for any recordings made in violation of applicable laws or the privacy rights of any individual.

Intellectual Property

All rights, title, and interest in and to the App — including its design, code, graphics, and branding — are owned by the developer. You are granted a limited, non-exclusive, non-transferable license to use the App on your personal Apple device in accordance with these terms.

You may not copy, modify, distribute, sell, or reverse-engineer any part of the App.

Your Content

You retain full ownership of all video and audio content you create with EverShot. We do not access, collect, or claim any rights over your recordings. All content stays on your device unless you choose to share it.

No Warranty

EverShot is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the App will be error-free, uninterrupted, or suitable for any particular purpose.

We are not responsible for any loss of recordings, data corruption, or device issues arising from use of the App.

Recordings can occasionally fail to save for reasons outside our control, such as insufficient device storage or interruptions from the operating system. We recommend confirming that important footage has been saved to your Photos library before relying on it or deleting it from your device. The App provides a recovery option for recordings that could not be saved automatically, but we cannot guarantee that every recording will be recoverable.

Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of — or inability to use — the App, even if we have been advised of the possibility of such damages.

Apple App Store Terms

These Terms are between you and the developer of EverShot, not with Apple. Apple is not responsible for the App or its content, and has no obligation to provide any maintenance or support for the App.

If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

You represent that you are not located in a country subject to a U.S. Government embargo and that you are not listed on any U.S. Government restricted-parties list.

Changes to the App

We reserve the right to modify, suspend, or discontinue the App or any part of it at any time without notice. We are not liable to you or any third party for any such changes.

Updates to These Terms

We may update these Terms and Conditions from time to time. When we do, the revised date at the top of this page will be updated. Continued use of the App after changes are posted constitutes your acceptance of the updated terms.

Governing Law

These terms are governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to conflict-of-law principles. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Tennessee.
