Overview

Gratitude Garden ("the App") is a gratitude journaling app that helps you build a daily gratitude practice, with an optional focus feature that can pause access to distracting apps until you've written your entry, and gentle daily reminders. This policy explains what the App accesses, how that information is used, and what we do — and don't do — with it.

Your journal entries are yours. They are created and stored only on your device. We never read, see, or store the content of your entries, and we have no server that receives them. The only information that currently leaves your device is the limited data needed to run subscriptions and validate purchases, described below.

Information We Do Not Collect

Your Journal Entries and On-Device Storage

Everything you write in Gratitude Garden — your entries, streaks, and the plants in your garden — is created and stored locally on your device. This content is never uploaded to our servers, and we have no way to access it.

Because your entries live only on your device, deleting the App removes them from that device. We do not keep a copy, so we cannot restore your entries for you.

Backups

Today, the App does not run its own cloud-sync service, and it does not send your entries to us or across your devices. If you want to preserve your journal, we recommend keeping your device's standard iCloud Backup or computer backup turned on (Settings → [your name] → iCloud → iCloud Backup). Those backups are managed and encrypted by Apple under your own Apple Account; we have no access to them.

We may add optional iCloud sync in the future. If we do, it will run entirely through your own private iCloud account, handled and encrypted by Apple — your entries would still not be sent to us, and we would not be able to read them. We will update this policy when that feature becomes available.

Screen Time and App Blocking

Gratitude Garden includes an optional focus feature that can temporarily restrict access to apps you choose until you've completed your gratitude entry. This is built on Apple's Screen Time / Family Controls framework and runs entirely on your device.

When you pick apps to block, Apple represents your choices as opaque, anonymized tokens — the App never learns the real names of the apps you selected, and this information is never transmitted anywhere. Nothing about your Screen Time activity or app usage is collected by us.

You can revoke the App's Screen Time access at any time in Settings → Screen Time on your iPhone.

Notifications

With your permission, the App sends local reminders to prompt your daily gratitude practice and, if you begin a free trial, a one-time reminder before it ends. These reminders are generated and scheduled on your device — we do not use a remote push service to track or profile you. You control whether reminders are on and can change or disable them at any time in the App or in Settings → Notifications.

Microphone and Voice Input

Gratitude Garden can let you speak your entries instead of typing them. If you use voice input, the App uses your device's microphone and Apple's speech recognition to turn what you say into text. This runs on your device — your audio is used only to produce the text of your entry, is not recorded or stored by us, and is not sent to us or to any third party. You are asked for microphone and speech-recognition permission before this is used, and you can grant or revoke it at any time in Settings → Privacy & Security. If you prefer not to use voice input, simply type your entries.

Analytics and Crash Reporting

Gratitude Garden does not currently use any analytics or crash-reporting service, and collects no usage or diagnostic data about you. If we add one in the future to help keep the App reliable, it would record only anonymous, aggregated information — never tied to your identity and never able to read your journal entries — and we would update this policy and our App Store privacy disclosures before turning it on.

Subscriptions and Purchase Data

Gratitude Garden offers auto-renewing subscriptions. Purchases are processed by Apple through the App Store — we never receive or store your payment card details.

To unlock features and manage your subscription, we use RevenueCat, Inc., a third-party service that records purchase events. For this purpose, RevenueCat and Apple may process a randomly generated app-user identifier (not tied to your name or email), your subscription and purchase history, and basic device and country information.

This data is used only to deliver and validate your subscription, prevent fraud, and understand aggregate purchase trends. It is never used to advertise to you and is not sold or shared. Because RevenueCat and Apple operate in the United States, this limited data may be processed there. You can review Apple's and RevenueCat's own privacy practices in their respective privacy policies.

Third-Party Services

The App relies on a small number of third-party services, used only to operate and maintain it:

The App contains no advertising networks, no analytics or tracking SDKs, and no third-party services beyond those described here.

Data Retention

Your journal content stays on your device for as long as you keep the App installed, and is under your control. The limited subscription data handled by Apple and RevenueCat is retained only as long as needed to provide and validate your subscription and to meet legal, accounting, and fraud-prevention obligations, after which it is deleted or anonymized.

Your Choices and Rights

Depending on where you live (for example, under the GDPR in the EU/UK or the CCPA/CPRA in California), you may have rights to access, correct, or delete the limited data associated with your purchases, and to know that we do not sell or share your personal information. Because that data is tied to an anonymous identifier rather than your identity, please contact us at hello@bentested.com and we will help you exercise those rights.

Children's Privacy

Gratitude Garden is not directed to children under 13 (or the minimum age required in your country), and we do not knowingly collect personal information from them. If you believe a child has provided information through the App, please contact us and we will take appropriate steps to address it.

Changes to This Policy

If we update this privacy policy, the new version will be reflected with a revised "last updated" date. We encourage you to review this page periodically.

Acceptance of Terms

By downloading or using Gratitude Garden ("the App"), provided by BENTESTED LLC ("we," "us," or "the developer"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use the App.

Eligibility

You must be at least 13 years old (or the age of digital consent in your country) to use the App. If you are under the age of majority where you live, you may use the App only with the involvement and consent of a parent or legal guardian. By using the App, you represent that you meet these requirements and are able to form a binding agreement.

Use of the App

Gratitude Garden is licensed to you for your personal use to build and maintain your own gratitude practice. The entries you write are yours. You agree to use the App only for lawful purposes and in a manner consistent with all applicable local, national, and international laws and regulations.

Subscriptions, Free Trial, and Billing

Gratitude Garden offers auto-renewing subscriptions that unlock the App's features:

Focus and App Blocking

The App includes an optional focus feature that, using Apple's Screen Time, can temporarily restrict access to apps you select until you complete your gratitude entry. You choose which apps to include and when this feature is active, and you are responsible for your own configuration.

You should not rely on this feature to block access to apps or functions you may need in an emergency or for any safety-critical purpose. To the fullest extent permitted by law, we are not liable for any consequences of apps being restricted while the feature is active, including any inability to access an app when you wanted or needed it.

Wellbeing and No Medical Advice

Gratitude Garden is designed to support a general gratitude and mindfulness practice. It is not a medical device, and it does not provide medical, psychological, or therapeutic advice, diagnosis, or treatment. The App is not a substitute for care from a qualified health professional.

If you are experiencing distress or a mental health crisis, please seek help from a qualified professional or your local emergency services.

Intellectual Property

All rights, title, and interest in and to the App — including its design, code, graphics, and branding — are owned by the developer, BENTESTED LLC. You are granted a limited, non-exclusive, non-transferable license to use the App on your personal Apple device in accordance with these terms. You may not copy, modify, distribute, sell, or reverse-engineer any part of the App.

Your Content

You retain full ownership of all journal entries and other content you create with Gratitude Garden. We do not access, collect, or claim any rights over your entries. Your content stays on your device unless you choose to share it.

No Warranty

Gratitude Garden is provided "as is" and "as available" without warranties of any kind, either express or implied, to the fullest extent permitted by law. We do not warrant that the App will be error-free, uninterrupted, or suitable for any particular purpose.

Your entries are stored only on your device. We are not responsible for any loss of journal entries, data corruption, or device issues arising from use of the App, and we recommend maintaining your own device backups to protect your entries.

Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of — or inability to use — the App, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for any claim relating to the App will not exceed the greater of the amount you paid us for the App in the twelve months before the claim, or USD $50. Nothing in these terms limits any rights you have that cannot be limited under applicable law.

Apple App Store Terms

These Terms are between you and the developer of Gratitude Garden, not with Apple. Apple is not responsible for the App or its content, and has no obligation to provide any maintenance or support for the App.

If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

You represent that you are not located in a country subject to a U.S. Government embargo and that you are not listed on any U.S. Government restricted-parties list.

Changes to the App

We reserve the right to modify, suspend, or discontinue the App or any part of it at any time without notice. We are not liable to you or any third party for any such changes.

Updates to These Terms

We may update these Terms and Conditions from time to time. When we do, the revised date at the top of this page will be updated. Continued use of the App after changes are posted constitutes your acceptance of the updated terms.

General

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the App and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions stay in full effect. Our failure to enforce any right or provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.

Governing Law

These terms are governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to conflict-of-law principles. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Tennessee, except where applicable law grants you the right to bring proceedings in your own country of residence.
